Assumption of Risk: Our products may contain extremely hot peppers and/or high levels of capsaicin and can cause intense heat reactions. By purchasing and/or consuming our products, you acknowledge and accept these risks and agree to use products responsibly.
Food Product Risk: Customer acknowledges that food products carry inherent risk, including potential foodborne illness, allergic reaction, or adverse sensitivity, and assumes all risks arising from consumption, storage, handling, misuse, or transport of our products.
Not Medical Advice: Our products are not intended to diagnose, treat, cure, or prevent any disease. No medical claims are made.
Allergens & Sensitivities: You are responsible for reviewing product ingredients and warnings before purchase and use. If you have allergies, sensitivities, or medical conditions, consult a qualified professional before use.
Cross-Contact: While ingredients are disclosed, we cannot guarantee products are free from trace allergens or cross-contact.
Use Restrictions: Do not allow children to consume super-hot pepper products. Not recommended for individuals who are pregnant or anyone with cardiovascular, gastrointestinal, respiratory, or other medical conditions without physician approval.
Proper Use: Use small amounts. Avoid contact with eyes and sensitive skin. Wash hands and surfaces after handling. Keep out of reach of children.
Storage Responsibility: Customer is responsible for proper storage and handling after delivery, including refrigeration (if applicable), and consumption before best-by dates or within reasonable time after opening.
Product Variability: Heat level, color, and texture may naturally vary by batch. Images and descriptions are illustrative and may differ slightly from received product.

Pricing, Accuracy & Corrections

Prices, promotions, and product descriptions are subject to change without notice.
We reserve the right to correct errors or inaccuracies (including pricing, descriptions, or availability) and to cancel affected orders.
If an order is canceled after payment due to an error, we will issue a refund to the original payment method.

Orders, Payment & Refusal of Service

We reserve the right to limit or cancel quantities purchased per person, household, or order.
We may refuse or cancel any order suspected of fraud, unauthorized activity, resale abuse, policy manipulation, or other improper conduct.
You agree to provide current, complete, and accurate purchase and account information for all orders.
Chargebacks: Initiating a chargeback or payment dispute without contacting us first may delay resolution. We reserve the right to dispute chargebacks using order, delivery, and communications records.

Shipping, Risk of Loss & Returns

All shipping, delivery, damage claims, lost packages, address accuracy requirements, return windows, exchanges, and refund rules are governed by our Shipping Policy and Return & Refund Policy. These policies are incorporated into these Terms by reference.

Risk of loss transfers to you upon carrier delivery confirmation (“Delivered” scan), as described in our Shipping Policy.
By placing an order, you agree to the timelines and conditions in those policies.

Recalls & Safety Notices

We may, at our discretion, issue safety notices, pauses, or recalls for any product or batch.
If a recall is initiated, your remedy will be as stated in the recall notice (which may include replacement, store credit, or refund), subject to applicable law.

Seeds & Legal Compliance

All seed purchases are subject to state and local agricultural restrictions.
You are solely responsible for verifying legality of shipment and planting in your location.
We are not liable for seizures, refusals, or regulatory actions affecting seed delivery.

User Conduct & Prohibited Uses

You agree not to use the Services to:

Violate any law or regulation.
Harass, abuse, defame, threaten, or discriminate against others.
Upload or transmit malicious code.
Interfere with or circumvent security features of the site, Shopify systems, or related networks.

Third-Party Tools & Links

We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, carrier interruptions, supply disruptions, labor actions, government actions, or internet/hosting outages.

Severability, No Waiver & Entire Agreement

If any provision of these Terms is found unlawful or unenforceable, the remaining provisions remain in full force.
Our failure to enforce any right or provision is not a waiver of that right or provision.
These Terms, together with our policies, constitute the entire agreement between you and Sinful Scoville.

Governing Law & Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute shall be brought in state or federal courts located in California, unless otherwise required by applicable law.
